Tlumach Terms of Service

These Terms of Service ("Terms") govern your use of the Tlumach mobile application (the "App"), distributed via Google Play under the package com.tlumach.app. By installing, opening, or using the App you agree to be bound by these Terms.

If you do not agree, do not use the App.

1. The service

Tlumach is an AI-powered language-learning companion that:

generates single practice sentences calibrated to your chosen stage in our communicative learning plan,
plays back synthesised audio (your device's text-to-speech on Free; cloud text-to-speech on Pro, with clips cached on your device),
lets you tap words for comfort-language glosses and translations,
builds a local vocabulary and grammar library ("Memories") as you practise,
offers review mode for sentences saved on your device,
tracks home statistics and optional Share your progress cards (including your chosen card style),
lets you choose interface language and audio playback preferences,
shows an optional UI coach tour for new users,
on Android, may send optional evening practice reminders when you have not practised for several days (on by default; disable in Settings; tapping a reminder can open your path and start practice),
may prompt you to install app updates through Google Play when a newer version is available.

Tlumach is not a substitute for professional language instruction, certification, or translation services.

Most learning history (saved sentences, vocabulary, and grammar notes) is stored on your device. Your account syncs learning paths and plan progress on our servers, but vocabulary and saved sentences do not automatically transfer to another device when you sign in there.

1.1 Notifications and background audio (Android)

Practice reminders and Pro background-playback controls use local Android notifications. Reminder timing is approximate (typically an evening window on inactive days); we do not guarantee delivery.

Pro background practice may run a foreground media service (with wake-lock where required) so audio continues when the screen is off. You can turn off evening reminders in Settings or block notifications in system settings. Denying notification permission may limit these features but does not remove core practice functionality while the App is open.

1.2 External links

The App may link to third-party pages (for example educational articles, support forms, the Valento Apps tester programme, or Google Play subscription management). We are not responsible for content or policies on those sites.

2. Eligibility

You must be at least 13 years old to use Tlumach. By using the App you confirm that you meet this requirement.

3. Your account

You sign in with your Google account via Google Sign-In. You are responsible for keeping your Google credentials safe; anyone who can sign in with your Google account can access your Tlumach paths and server-side progress.

If several people use the same device with different Google accounts, each account's server-side paths are separate; local caches from a previous account may remain until cleared in Storage on this device or removed by uninstalling the App.

4. Plans and purchases

The App includes a Free tier and an optional Pro subscription sold through Google Play:

Pro subscription	Unlimited new practice sentences; cloud text-to-speech pronunciation (cached on device); up to 25 learning paths; up to 45 minutes of fresh practice per session before the session work timer pauses new generation; uninterrupted background practice with the screen off on supported Android devices.

We may also grant VIP (complimentary Pro) access to selected accounts without Google Play billing. VIP access follows the same Pro features but is not managed through Google Play.

All paid purchases are processed by Google Play. Tlumach never sees your payment-method details. The App currently sells a weekly Pro subscription only (no consumable energy packs or one-time top-ups in the client).

Daily sentence limits count new lines served from the shared pool or generated by AI, not replay of sentences already saved on your device.

4.1 Pro subscription billing

Pro is an auto-renewing weekly subscription at the price displayed at purchase time, in your Google Play account's local currency, until cancelled.
You can change, pause, or cancel your subscription at any time in Google Play → Subscriptions or via Settings → Manage subscription inside the App.
Cancellation takes effect at the end of the current billing period; you keep Pro access until then.
A grace period of up to 7 days is provided when a payment fails so you can update your payment method without losing service.
Deleting your Tlumach account does not cancel Google Play billing; cancel the subscription separately if you no longer want to be charged.

4.2 Refunds

Refunds for subscriptions are handled directly by Google Play according to Google's refund policy. You can request a refund from play.google.com/store/account/orderhistory.

If a refund is issued, your matching Pro entitlement is removed automatically.

5. Acceptable use

You agree not to:

reverse-engineer, decompile, or attempt to extract source code or prompts from the App;
use the App to generate, store, or distribute illegal, defamatory, hateful, sexually explicit, or harassing content;
use scrapers, bots, or other automated means to interact with the App;
circumvent the entitlement system or share your account with others.

6. Generated content

Sentences, translations, and audio Tlumach produces are generated by AI models. While we tune the system carefully, the output:

may occasionally contain factual or grammatical errors,
must not be treated as legal, medical, financial, or other professional advice,
may not be used for any purpose that violates the AI provider's acceptable-use policy.

7. Intellectual property

We retain all rights, title, and interest in the App, including its brand, design, code, and prompt engineering. You receive a personal, revocable, non-transferable, non-exclusive licence to use the App on devices you own.

8. Termination

We may suspend or terminate your access to the App if you violate these Terms or attempt to defraud the entitlement system. You may stop using the App at any time by uninstalling it and (optionally) deleting your account from Settings → Delete my account now.

Termination does not automatically refund unused subscription time unless required by law. Local data may remain on your device until you clear storage or uninstall.

9. Disclaimer of warranties

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the App is limited to the greater of (a) the amount you paid us through Google Play in the 12 months preceding the claim and (b) 5 EUR. We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Changes to these Terms

We may update these Terms when the service changes. Material changes will be announced in-app. Continued use after changes take effect means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the publisher's principal place of business, without regard to its conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction unless a mandatory consumer-protection law of your country says otherwise.
